Before you place an order or book a catering event, please read these terms. They protect both of us. Ordering from Delicias means you agree to everything below.

By accessing our website, placing an order, or making a reservation at Delicias Restaurant & Grill, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or services.
These terms apply to all users including diners, delivery customers, catering clients and anyone who visits our physical location after interacting with our digital platforms. We reserve the right to update these terms at any time. Changes become effective immediately when posted on this page. Your continued use of our services after changes means you accept the updated terms.
When you place an order through our website for pickup or delivery, you are making an offer to purchase food items at the prices shown. We accept major credit cards, debit cards and digital wallets like Apple Pay and Google Pay. All prices are in US dollars and do not include applicable sales tax unless stated otherwise.
Your payment is processed at the time you place the order. We use third party payment processors. We do not store your full credit card information on our own servers. If your payment is declined, your order will not be prepared. You are responsible for providing accurate billing information.
We reserve the right to change menu prices without notice. However, the price shown at checkout is the price you pay. If a menu item is unavailable after you order, we will contact you to offer a substitute or refund that specific item.
Delivery is available within a six mile radius of our physical location at 123 Mexican Kitchen Lane, Austin, Texas. Delivery fees are calculated at checkout based on distance and order size. Delivery fees do not include gratuity for the driver.
Estimated delivery times are provided when you order. These are estimates only. We are not responsible for delays caused by traffic, weather, incorrect address information, or issues with third party delivery partners. If your delivery address is incorrect and our driver cannot reach you, your food may be returned to our kitchen and you will not receive a refund.
All delivery orders require a valid phone number so our driver can contact you upon arrival. If you do not answer the phone or door within ten minutes of arrival, the order will be returned and no refund will be issued.
When you select pickup, your order will be ready at the time shown on your confirmation email or text message. You must pick up your order within sixty minutes of the stated ready time. After sixty minutes, we cannot guarantee food quality or temperature.
If you do not pick up your order within two hours, we reserve the right to discard it for food safety reasons. No refund will be issued for orders not picked up within two hours. To avoid this, please call us if you are running late. We will hold your food for an additional thirty minutes if you communicate with us directly.
You must show your order confirmation number or the credit card used to place the order when you arrive for pickup. This prevents someone else from taking your food by mistake.
All catering orders require a signed agreement and a non refundable deposit. The deposit amount is fifty percent of the total estimated invoice for events under one thousand dollars. For events over one thousand dollars, the deposit is thirty percent.
The remaining balance is due five business days before your event date. If you cancel your catering order, the deposit is not refundable for any reason. This includes weather, illness or venue changes. We begin shopping for ingredients and scheduling staff as soon as you sign the agreement. That is why we cannot return deposits.
If you cancel more than fourteen days before your event, you receive a credit for the deposit amount toward a future catering order within twelve months. If you cancel within fourteen days of the event, the deposit is forfeited with no credit.
For regular pickup or delivery orders, you may cancel within fifteen minutes of placing the order for a full refund. After fifteen minutes, our kitchen may have already started preparing your food. In that case, cancellation is not possible and no refund will be issued.
If you receive food that is incorrect, undercooked or missing items, contact us immediately by phone within sixty minutes of pickup or delivery. We will remake the correct items at no charge or issue a partial refund for the missing or wrong item. We do not offer refunds for taste preferences or complaints about portion size.
For refunds approved by our team, we will credit the original payment method within five to ten business days. We do not offer cash refunds for orders paid by card.
Delicias prepares all food in a kitchen that handles common allergens including wheat, dairy, eggs, soy, tree nuts, peanuts, fish and shellfish. While we take allergy requests seriously and will clean surfaces and use separate utensils when you inform us, we cannot guarantee a completely allergen free environment.
Cross contamination is always possible in a shared kitchen. You assume all risk related to food allergies when you order from us. You must clearly state any life threatening allergies when placing your order. Our staff will do their best to accommodate you, but we cannot be held legally responsible for allergic reactions.
For customers with celiac disease or severe gluten sensitivity, we offer corn tortillas and other naturally gluten free items. However, our kitchen handles flour tortillas and breaded items. Please make your own informed decision based on your level of sensitivity.
Delicias Restaurant & Grill is not liable for any indirect, incidental or consequential damages arising from your use of our website or consumption of our food. This includes but is not limited to food borne illness, allergic reactions, delivery delays or dissatisfaction with taste.
Our total liability to you for any claim related to your order is limited to the amount you paid for that specific order. We are not responsible for any damages exceeding that amount. Some states do not allow limitations on liability. In those states, this limitation applies to the fullest extent permitted by law.
Our website is provided on an as is basis. We do not guarantee that the website will be error free, secure or continuously available.
All content on this website including menu descriptions, photographs, logos, recipe names and written copy is the property of Delicias Restaurant & Grill. You may not copy, reproduce, distribute or use our content for commercial purposes without our written permission.
You may share our website on social media for personal, non commercial use. You may not download or modify any part of our website for any reason. Unauthorized use of our intellectual property may result in legal action.
These terms are governed by the laws of the State of Texas and applicable federal laws of the United States. Any dispute arising from these terms or your use of our services shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
You agree to waive any right to a jury trial or to participate in a class action lawsuit against Delicias. All disputes must be filed within one year of the date the claim arose. Claims filed after one year are barred.
If any part of these terms is found to be unenforceable, the remaining parts remain in full effect. Our failure to enforce any right under these terms does not waive that right.
For dinner reservations of six or more people, we require a credit card to hold your table. If you do not show up for your reservation and do not call to cancel at least two hours in advance, we may charge a no show fee of twenty five dollars per person.
For private event reservations including buyouts or party rooms, the no show fee is one hundred percent of the estimated food and beverage minimum. Please call us if your plans change. We are reasonable with honest communication.
